Student Visa


If you hold a valid visa other than a valid student visa, you can only enroll into a short study program with enroll period as permitted in your visa.


You will need to have a valid student visa if you have decided to study for a formal course in Australia.



Visa Label Free


Under the current Australia's electronic visa system, there is no requirement to have your visa label placed in your passport.


It is therefore very important that you remember your current visa expiry date.  You need to either apply for a new visa or leave Australia before your visa is expired


If you overstay your visa and become unlawful citizen in Australia, you might be bar for 3 years to apply for any new visa to return to Australia.


If you wish to have a visa label placed in your passport, you can apply for it at any DIBP office with a fee of A$70.



Student Visa Subclass


There are 7 different student visa subclasses for various types of courses.  These are:


570 - Independent ELICOS (English language program)

571 - Schools (Primary or high schools)

572 - Vocational (Diploma and Certificates training program)

573 - Bachelor, Graduate Certificate or Gradiate Diploma and Masters degree  by course works.

574 - Master or Doctoral degree - research program.

575 - University Foundation studies or other non-award program.

576 - AusAID or Defence (Government scholarship or Defence related programs)



Student Visa Assessment Level


Depending on the country or region of passport you are using to apply for your student visa as well as the type of program you will be studying in Australia, you will be assessed against one of the 3 assessment levels.


Assessment level 1 is the lowest risk and assessment level 3 is the highest risk.

Course packaging


If you packaging your courses in your student visa application, your application will be assessed against the highest assessment level in your main course of study.



Onshore or Offshore application?


If your application will be assessed against assessment level 1, you can apply for your first student visa in Australia while you are holding a valid visa in Australia.


You can also apply to renew or extend your student visa in Australia if you are holding a valid student visa in Australia.


If your assessment level is 2 or 3, you must apply for your first student visa at appropriate DIBP offshore visa centre in your country or region.



Streamlined Visa Processing


If you are planning to do Bachelor , Masters or Doctoral degree at a participating university, your student visa will be assessed on assessment level similar to Assessment Level 1.



Student Visa conditions

Below are the brief of some of the most commonly found visa conditions attached to student Visa:

Mandatory conditions:

1. You cannot work more than 40 hours for fortnight while your course is in session.

2. You cannot undertake work until you have started your course in Australia.


8202

 1. You must remain enrolled in a registered course.

 2.  You must maintain satisfactory attendance.

 3.  You must maintain satisfactory course progress for each study period as required by your education provider.

You must maintain adequate Overseas Student Health Cover (OSHC)


8516

You must continue to satisfy the requirements for grant of your student visa.


8517

You must maintain adequate arrangement for school age dependent to your student visa.


8532

If you are under 18 years old, you must have approved guardianship and accommodation arrangement.

You must notify your education provider of your residential address in Australian within 7 days of arriving or any change of residential address in Australia.

You are not entitled to be granted a further substantive visa other than 1.  a student visa with permission to work.  2.  a further student guardian visa 3. "Refugees or protection" visa.

Student Guardian Visa

If you are a parent or legal custodian of a student younger than 18 years of age studying in Australia on a student visa, it is possible for you to apply for a Student guardian visa to be a guardian for the student.


As student guardian, you will need to provide accommodation, general welfare and other support to the student and live with the student while the student is studying in Australia.


While acting as student guardian for the student, you must maintain adequate health cover and not depart Australia without the student or until proper accommodation and guardianship arrangement has been completed and approved by the relevant education provider.


Student guardian visa holder can enroll to do maximum 3 months study.  However, there is no restriction on the visa holder to enroll to do part-time; maximum of 20 hours per week of English language program.


Student guardian visa is restricted from seeking work while in Australia.
