Business Innovation and Investment (Subclass 188) Visa
(4 years Provisional Visa).
You can apply for this class of visa under 1 of the 3 streams as listed below:
Significant Investor Stream
- As from 24th November 2012
Received invitation to apply for this visa
No point test.
Investment amount A$5 millions for a minimum period of 4 years.
Minimum of A$1,500,000 must invest in sponsoring state's Treasury bond; balance can invest in approved managed fund or private companies which operating a qualifying business.
Investment fund must be legally accumulated and owned.
Applicant must be nominated by state government and go through EOI process and invited by DIBP to lodge visa application.
No upper age limit.
No English requirement.
Nominated by state or territory government agency.
Genuine intention to reside in the state or territory which nominated you.
live in Australia for at least 160 days over four years while holding this visa
Able to apply for 2 extensions of 2 years each (total 4 years).
live in Australia for at least 240 days or 320 days over six or Eight years while holding this visa (extension).
You and your partner must have had no involvement in unacceptable business or investment activities.
Investor Stream
Received invitation to apply for this visa
Score at least 65 on the points test
Under 55 years of age or waive by nominating state or territory.
- Have an overall successful record of eligible investment or qualifying business activities
Have high level of management skills and actively directly involvement in managing eligible investments or of a qualifying business activities for at least 3 years.
In 1 out of 5 fiscal years, directly managed a qualifying business which you or with your partner combined owned at least 10% in the business or
In 1 out of 5 fiscal years, directly managed at least AUD1.5 million in eligible investment owned by you or with your partner combined.
Has combined business, investment and personal assets of at least AUD2.25 million for 2 years and are available for legal transfer to Australia.
Make at least AUD1.5 million investment in nominated state or territory's government security for at least 4 years.
You and your partner must have had no involvement in unacceptable business or investment activities.
Business Innovation stream
Received invitation to apply for this visa
Score at least 65 on the points test
Under 55 years of age or waive by nominating state or territory.
- Have business turnover of at least AUD500,000 in 2 out of 4 fiscal years in an established business or businesses.
- Ownership in the nominated main business:- 51% if turnover is less than AUD400,000 per year.- 30% if turnover is AUD400,000 or more per year.- 10% if the business is a publicly listed company.
- Have successful business career.
Have a genuine desire to continuously own and maintain a management role in a business in Australia.
Have combined net assets of AUD800,000 for legal transfer to Australia within 2 years of the visa being granted.
You and your partner must have had no involvement in unacceptable business or investment activities.
Business Talent; Subclass 132 Visa (Permanent Visa)
You can consider applying for Business talent Visa (Permanent Visa) for migration to Australia in 1 of the 2 streams:
Significant Business History Stream:
- Nominated by State or Territory government agency.
- No history of involvement in unacceptable business activities.
- Received invitation by DIBP to apply.
- You had not turned 55 at time of invitation or exceptional economic benefit to the nominated state or territory.
- Successful business career.
You and your spouse together in at least 2 of the 4 financial years has a qualifying business ownership interest of at least AUD$400,000 or 10% of shareholding in a public listed company.
the main business turnover in at least 2 of the 4 financial years of at least A$3,000,000.
Ownership interest in a main business
- 51% if annual turnover less than AUD400,000 per year
- 30% if annual turnover is AUD400,000 or more.
- 10% if publicly listed company.
You and your spouse together have legally owned business and personal assets of at least A$1,500,000.
You have realistic commitment to establish or participate and maintain a substantial ownership interest in a business in Australia
You maintain direct and continuous involvement in management of the business which benefits the Australian economy.
Venture Capital Entrepreneur stream:
Received at least AUD 1 million in funding from an Australian Venture capital firm to start-up, product commercialisation or business development of a promising high-value business idea or expansion of a business in Australia.
Nominated by state or territory government agency.
You have realistic commitment to establish or participate and maintain a substantial ownership interest in a business in Australia

Business Innovation and Investment (Subclass 888) Visa
(Permanent Visa)
You can apply for this class of permanent visa under 1 of the 3 streams as listed below:
Significant Investor Stream
- Holding a Subclass 188 visa in the Significant Investor stream or in the significant Investor Extension Stream.
- Been in Australia for 160 days in the past 4 years or
- Been in Australia for 240 days in the past 6 years or
- Been in Australia for 320 days in the past 8 years.
- Held complying investments continuously for 4 years.
- Operated a qualifying business in a private Australian company under company investment if applicable.
Investor stream
- Been in Australia for at least 2 out of 4 years
- Held the designed investment for at least 4 years.
Business Innovation stream
- If you are holding a Business Innovation and Investment visa (subclass 188) or
- holding Special category; subclass 444 visa or Business (Long stay); Subclass 457IE visa and met the requirements of the business innovation stream,
- Nominated by state or territory government agency
- Held one of the above visa in Australia at least 1 year in two year before apply.
- Show ongoing business involvement:
- have ownership interest in a business
- direct and continuous management role in an actively operating main business in Australia for 2 years
- Annual turnover of at least $300,000 for 12 months or waive by nominating state or territory if business is in regional area.
- Ownership interest in a main business
- 51% if annual turnover less than AUD400,000 per year
- 30% if annual turnover is AUD400,000 or more.
- 10% if publicly listed company.
- Main business has Australian Business Number.
- 2 years of Business Activity Statements
- Main business was not acquired from other business visa holder unless had a joint interest in the business for at least 1 year.
- (With partner) have combined net business assets of AUD200,000
- Has personal and business assets of A$600,000 in Australia for 12 months.
- main business employed at least the equivalent of 2 full-time local employees.
